A 2 year-old patient presented to the emergency department with flu-like symptoms and after assessment, was provided fluids by intravenous (IV) solution for dehydration. During the course of administering the IV, the patient became non-responsive and a Code Blue was called. Despite lengthy administration of resuscitative efforts, the patient passed away. The coroner determined the cause of death to be air embolism. Prior to filing a lawsuit with multiple claims for negligence and wrongful death, the hospital agreed to pay the settlement demand of $1,200,000, the maximum amount for all available causes of action under the Medical Injury Compensation Reform Act (MICRA).
Losing a two-year-old child to a preventable medical error is devastating, and navigating a legal system designed to cap what hospitals owe makes it even harder. Yuhl Carr has the knowledge of MICRA and California medical malpractice law to pursue every dollar available to grieving families.
